The Governing Board approved the Consent Agenda items as follows:
The Governing Board appointed Adam Cox, Student Representative, and reappointed Richard Jantz as the Economic Development representative to the Citizens Advisory Committee.
The Governing Board accepted the 2002-2005 Transit System Performance Audit as presented. Marjie Kirn stated that the audit identified that “The Bus” had not met the fare box ratio requirements for the Dial-A-Ride service in the urban area for all three years under audit. Under the Transportation Development Act, MCAG has the responsibility to review compliance and implement penalties if the ratios are not met. Staff requested leeway by the Board to determine what penalties should be imposed on the Transit Department and come back to the Board with staff’s recommendations.
Due to the nature and importance of the Atwater-Merced Expressway document and the overall delivery of the project, a legal review of the environmental document, by a firm with substantial knowledge and experience with California Environmental Quality Act issues involving major transportation projects is merited. The Governing Board authorized the Executive Director to execute an agreement for legal services with the Law Office of Thomas H. Terpstra for the Atwater-Merced Expressway Project.
Director Joe Oliveira was elected to be the MCAG Governing Board chair for the 08/09 fiscal year with Director John Pedrozo to serve as vice chair.
